Warranty
We are so proud of our products we offer an industry leading 1 Full Year Warranty against any manufacturing defects. In fact, we frequently make repairs, for free, beyond the 1 year date. If you have any concerns at all just reach out to our team.

  1. WARRANTY. BrandNew Industries, Inc., a California corporation, warrants that the Product shall be free from defects in materials and workmanship, excluding normal wear and tear, for a period of one (1)year from the date the Project is received by Customer (the “Warranty Period”), assuming the Product is used with due care and in accordance with all recommendations of BrandNew Industries. In the event a defect is identified during the Warranty Period, Customer shall promptly notify BrandNew Industries and return the Product for repair or replacement. If BrandNew Industries determines that a defect exists, it will repair or replace the Product without cost to Customer. The foregoing limited warranty is in lieu of all other warranties of BrandNew Industries and BrandNew Industries disclaims all other warranties, express or implied, including without limitation any implied warranty of merchantability, fitness or adequacy for any particular purpose or use, quality or capacity.
  2. ENTIRE AGREEMENT/MODIFICATIONS. The Proposal and this Addendum and any exhibits incorporated herein constitute the entire agreement between the parties and supersede all prior agreements and understandings of the parties relating to the subject matter hereof. Neither the Proposal nor this Addendum may be modified in any way except by an instrument in writing signed by each of the parties hereto.
  3. SEVERABLE PROVISIONS. If any provision of the Proposal or this Addendum is determined to be void, invalid or otherwise unenforceable, in whole or in part, the remaining provisions shall nevertheless continue in full force and effect.
  4. SUCCESSORS. The provisions of the Proposal and this Addendum shall be binding upon and shall inure to the benefit of the parties and their respective successors, assigns,executors, administrators and heirs.
  5. CONSTRUCTION. Headings at the beginning of each paragraph and subparagraph of this Addendum are solely for the convenience of the parties and are not a part hereof.Whenever required by the context, the singular shall include the plural and the masculine shall include the feminine and vice versa. All exhibits referred to in or attached to the Proposal or this Addendum and incorporated by this reference. The parties agree that the rule that ambiguities are construed against the drafter of a writing shall not apply in any dispute under the Proposal or this Addendum.
  6. COUNTERPARTS. The Proposal and this Addendum may be executed in any number of counterparts, each of which shall be deemed to be an original, but all of which together shall constitute one and the same instrument.
  7. FACSIMILE SIGNATURES. In the event executed copies of the Proposal or this Addendum are provided by one party to the other by facsimile transmission, the facsimile copies and the signatures thereon shall for all purposes be treated as originals.
  8. GOVERNING LAW. The parties expressly agree that (i) the Proposal and this Addendum shall be governed by, interpreted under and enforced in accordance with the laws of the United States of America and the State of California, (ii) in the event of any dispute, the parties shall be subject to the jurisdiction of the courts of the State of California,regardless of their place of residence, and (iii) in any action arising in connection with this Proposal or this Addendum, venue shall be in the County of Santa Barbara, State of California, United States of America.
  9. FORCE MAJEURE. BrandNew Industries shall not be liable to Customer for any losses or damages attributable to an event or circumstance which is beyond the reasonable control of BrandNew Industries and without its fault (including, without limitation, effects of fire, strike, war, insurrection, terrorism, acts of God, civil or military authority, civil disturbance and government restriction or prohibition), and the performance of BrandNew Industries’ obligations hereunder shall be suspended during the existence of such cause.
  10. LIMITATION OF REMEDIES AND LIABILITY. The cumulative liability of BrandNew Industries to Customer for all claims relating to the Product (including without limitation the limited warranty provided pursuant to Section 2) shall be limited to the total amount paid by Customer for the Product. In no event shall BrandNew Industries be liable for any consequential, indirect, special or incidental damages (including, without limitation, damages for loss of business profits, business interruption or other pecuniary loss), whether arising out of contract, tort, warranty or otherwise, even if BrandNew Industries has been advised of the possibility of such potential loss or damage. The foregoing limitation of liability shall apply regardless of the success or effectiveness of other remedies. Customer acknowledges that the price charged for the Product has been agreed to by BrandNew Industries in reliance on the allocation of risk and limitation of liability set forth in Section 2 and this Section 11.
  11. ATTORNEYS’ FEES. In any action at law or in equity arising out of the Proposal or this Addendum, the prevailing party shall be entitled to reasonable attorneys’ fees in addition to any other relief awarded to said party.
Returns
We have a 30-day return policy, which means you have 30 days after receiving your item to request a return.

Exceptions / non-returnable items
Custom items and gift cards are not eligible for return.

To be eligible for a return, your item must be in the same condition that you received it, unworn or unused.

Damages and issues
Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

Exchanges
The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.

European Union 14 day cooling off period
Notwithstanding the above, if the merchandise is being shipped into the European Union, you have the right to cancel or return your order within 14 days, for any reason and without a justification. As above, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

 

Refunds
We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within 10 business days. Please remember it can take some time for your bank or credit card company to process and post the refund too.
